All operations shall be on an unprotected and non—harmful interference basis, i.e., Intelsat shall not cause harmful interference to, and shall not claim protection from, interference caused to it by any other lawfully operating station. 2. In the event that there is a report of interference, Intelsat must immediately terminate transmissions and notify the FCC in writing. 3. Any action taken or expense incurred as a result of operations pursuant to this special temporary authority is solely at Intelsat‘s risk. 4. This is granted without prejudice to any future FCC enforcement action in connection with any unauthorized operation of radio facilities. 5. Grant of this authorization is without prejudice to any determination that the Commission may make regarding Intelsat‘s pending application SES—MFS—20120913—00816 6. This action is issued pursuant to Section 0.261 of the Commission‘s rules on delegated authority, 47 C.F.R. § 0.261, and is effective immediately. Washington, D.C. 20554 INTELSAT Re: Request for Special Temporary Authority Hagerstown, Maryland C—band Earth Station EO00355 Dear Ms. Dortch: Intelsat License LLC ("Intelsat") herein requests a grant of Special Temporary Authority ("STA")‘ for 60 days, commencing from date of grant, to utilize its Hagerstown, Maryland C—band earth station —— call sign E000355 —— prior to grant of permanent operating authority. The antenna will communicate in the frequency bands 3700—4200 MHz (downlink) and 5925—6425 MHz (uplink) with the SES—4 satellite at 22.0° W.L.* Intelsat has a pending application for authority to use this antenna to transmit in the conventional C—band to satellites on the Permitted Space Station List on a permanent basis." In support of this request, Intelsat incorporates by reference its pending application for authority to use this antenna to transmit to Permitted List satellites on a permanent basis." The application contains detailed technical information (in Exhibits A, C, E, and F) that demonstrates that the operation of the earth station will be compatible with its electromagnetic environment and will not cause harmful interference into any lawfully operating facility. In the extremely unlikely event that harmful interference should occur, Intelsat will take all reasonable steps to eliminate the interference. Grant of this STA request will enable Intelsat to commence a customer service using this earth station to communicate with the SES—4 satellite in accordance with the schedule that has been communicated to the customer, thereby serving the public interest.
