Dear Mr. Kambic:

On June 4, 2102, the Commonwealth of Pennsylvania (COP) filed the above captioned
application for temporary authority (STA) to operate a Ku—Band mobile uplink Satellite News
Gathering (SNG) truck earth station. For the reason stated below, we dismiss this application as
defective.

Section 25.112(a) of the Commission‘s rules, requires the Commission to return, as unacceptable
for filing, any earth station application that is not substantially complete, or does not comply with
the Commission‘s rules.‘ COP‘s application does not comply with the Commission‘s rules,
rendering it unacceptable and subject to dismissal for the following reasons.

Section 25.120(a) of the Commission‘s rules® requires STA requests to contain "the full
particulars of the proposed operation." This includes frequency bands, powers and points of
communication. COP did not submit information detailing the particulars of its proposed SNG
operations in its STA application.

In addition, Section 25.120(a) of the Commissions‘ rules", requires that STA requests include all
facts sufficient to justify the temporary authority sought. COP did not provide any such
information in its STA request. Without this information, we cannot make a finding that
extraordinary circumstances require immediate operation and that a delay in these operations
would seriously prejudice the public interest."

Accordingly, pursuant to Section 25.112 of the Commission‘s rules, and Section 0.261 of the
Commission‘s rules on delegations of authority," we dismiss the application of Commonwealth of
Pennsylvania as defective.
