    Dear Ms. Kam:

    On April1, 2005, Clear Channel Satellte Services (‘Clear Channel") filed an application
    for license for a Ku—band VSAT network. For the following reason, we are denying your
    application.
    Section 25.113(e) and Part 17 of the Commission‘s rulesrequires applicants for new
    earth station licenses to notify the Federal Aviation Administration (FAA) under many
    circumstances. In particular, Section 17.7(b)(1) requires earth station applicants within
    6.1 kilometers from an sirport runway to notify the FAA if a line from the top of their
    planned antennas to the closest point of the closest runway will be steeper than 100 to 1.
    According to Clear Channel‘s application, the hub station antenna structure located at
    Arapahoe, Denver, C is within 6.1 kilometers from the nearest pointofthe nearest
    runway of Centennial Airport. Accordingly, this proposed antenna structure must either
    meet the slope restrictions contained in Section 17.7(b¥(1) of the Commission‘s rules, or
    Clear Channel must notify the FAA.
    Our analysis of the proposed antenna structure for the hub station shows that Clear
    Channel‘s proposed antenna structure fails to meet the 100 to 1 slope required by Section
    17.7(b(1). Moreover, on FCC Form 312, Schedule B, Question E20, Clear Channel
    indicated that no FAA Notifation is necessary. For these reasons, we find that Clear
    Channel‘s application does not comply with the slope and/or FAA notification
    requirements contained in Section 17.7 of the Commission‘s rules. Therefore, we are

denying your application, without prejudice, pursuant to Sections 25.113(e) and
25.17.76)(1), 47 C.FR. §§ 25.113(6), 17.7(b)(0), for failure to comply with the
Commission‘s Rules.
