(PanAmSat) for special temporary authority for a period of 30 days, commencing October 6, 2010, to conduct telemetry, tracking, and telecommand (TT&C) operations with the Galaxy 15 space station (Call Sign $2387) outside the +/—0.05° east/west station—keeping box previously authorized for Galaxy 15 is granted.‘ This authorization shall be in accordance with the technical specifications set forth in PanAmSat‘s application, Federal Communication Commission (Commission) rules, and the following conditions: 1: PanAmSat is required to accept interference from other lawfully operating space stations or radio communications systems. 2. ("PanAmSat"), pursuant to Section 25.210 of the rules of the Federal Communications Commission ("FCC" or "Commission")," herein requests an additional 30 days, from October 6, 2010 through November 4, 2010, of the Special Temporary Authority ("STA") previously granted PanAmSat to conduct Telemetry, Tracking and Command (TT&C) operations _ ‘on the Galaxy 15 satellite (call sign $2387) outside of the +/— 0.05° East/West station—keeping box gursuant to a waiver of Section 25.210(j) of the ' Commission‘s rules. As PanAmSat previously has informed the International Bureau ("Bureau") staff, on April 5, 2010, the Galaxy 15 satellite suffered an anomaly of unknown origin. Dortch September 29, 2010 Page 2 authorlzed +/— 0.05° East/West station—keeping box pursuant to STA.* During the time period covered by this STA request, Galaxy 15 will be located between approx1mately 114.152°W.L. and 108.825° W.L. — Grant of this STA further extension request is in the pubhc interest. The Commission may grant waiver for good cause shown.‘ The Commission typically grants a waiver where the partlcular facts make strict compliance inconsistent with the public interest.© In granting a waiver, the Commission may take into account considerations of hardship, equity, or more effective implementation of overall policy on an individual basis.‘ Waiver is therefore appropriate if special circumstances warrant a deviation from the general rule, _ and such a deviation will serve the public interest. Good cause exists in this case based on hardship. Due to the technical anomaly on the Galaxy 15 satellite, PanAmSat is unable to comply with the requirements of Section 25.210(j) of the Commission‘s rules.
