Dear Mr. Jacobs:
        Thisleter requests information about Pegasus Development Corporation‘s (Peaasus) intentto
pursue the above—referenced modification applications. In August 2001, the International Bureau
muthorized Pegssus to Inunch and operate a Ka—band satelte system atfive orbital lcations, including
107° W.L. and 117° W.L._ n March 2002, Pegasus fled a modification application t add a
Broadcasting Satellite Service(BSS) payload t ts authorizations at the 117° W.L. and 107° W.L.. orbital
locations, using the 17.3—17.8 GHz (downlink) and 24.75—25.25 GHz (uplink)frequency bands. (SAT—
MOD—20020322—00035 and SAT—MOD—20020322—00036,respectively) Subsequently,the Iternational
Bureau‘s Satelite Division declared Pegasus‘s Ka—band authorization at the 117° W.L. orbiallocation
null and void."
         Pegasus‘s modification applieations fo the BSS payloads remain pending. In light ofhe passage
oftime and changed circumstances with respect to is Ka—band system, we request that Pegnsus notify us
whether t intends to operatea single—band BSS system at the 117° W.L. orbital location. In addition,
please advise whether Pegasusitends to pursue ts applicationto ad a BSS payload to it authorization
at the 107° W.L. orbital location. If Pegasus does notintend to pursue a BSS payload at eithe the 117°
W.L.or 107° W.L. orbital locations, please submita notice of withdrawal. Pegasus‘s response should be
