Following completionof this transaction, Datal h expects t le a registration statement with the U.S. Securities and Exchange Commussion relating to the anticipated offering of DataPath‘s shares to the public, within a few months after the sale by the investment bank. DataPath is a leading provider of satellite communications networks, primarily for the U.S. Department of Defense. DataPath designs, engineers, integrates and produces earth stations and earth terminals that transmit information via orbiting satellite, forming satellite communications networks that connect multiple users anywhere around the world. DataPath also provides engineering staff to install, operate and maintain these networks, as well as software to optimize network performances. DataPath sells its products and services in the market for command, control, communications, computation, intelligence, surveillance and reconnaissance purposes. Due to the complicated nature of this transaction, it is possible that the sale of DataPath‘s stock to institutional investors will occur as early as June 28, 2006. DataPath Post—Offering respectfully requests that the FCC grant this application for a STA for a period of 60 days while the International Bureau staff processes the separately filed transfer of control application.
