Special Temporary Authority application - Explanation

Please explain in the area below why an STA is necessary:
Pursuant to Section 5.61 of the Rules, The Boeing Company (?Boeing?) respectfully requests that the Commission authorize it, on a temporary basis during the pendency of Boeing?s application to modify existing experimental station license Call Sign WC2XVE, for a period commencing on September 12, 2002, and not to exceed six months: (i) to operate its authorized experimental stations on U.S. aircraft in international airspace; (ii) to operate its stations using additional emission designators; (iii) to conduct experiments under a contractual agreement with the Unites States Government; (iv) to conduct limited market studies; and (v) to add the EUTELSAT II-F4 and Atlantic Bird 2 satellites as authorized points of communication for experimental stations on U.S. aircraft in international airspace. See The Boeing Company, Experimental Radio Station Application, File No. 0032-EX-PL-2002 (filed June 3, 2002) (?Experimental Modification Application?). This STA request is a renewal of an STA granted on July 12, 2002, that expires at 3:00 a.m. EST on September 12, 2002. See The Boeing Company, Experimental Special Temporary Authorization, File No. 0215-EX-ST-2002 (granted July 12, 2002). As demonstrated in the Experimental Modification Application, as supplemented herein, expanding Boeing?s experimental operations in the manner requested would strongly serve the public interest. The public interest factors, technical data and other information supporting grant of Boeing?s Experimental Modification Application are set forth fully therein and, in the interests of administrative convenience, are hereby incorporated by reference. Additionally, Boeing incorporates by reference the information set forth in its original STA request and related correspondence, upon which the present STA was granted. Accordingly, this STA renewal request focuses on the need for continuing temporary authority to conduct the additional experimental operations described in the Experimental Modification Application. Boeing?s request to renew its special temporary authority commencing on September 12, 2002, is prompted by the ongoing need to test and demonstrate its experimental aircraft stations over the Atlantic Ocean and nearby geographic regions. As the Commission is aware, Boeing's existing STA enabled Boeing to test its experimental stations aboard U.S. Government aircraft, to verify its satellite communications links over the North Atlantic and to participate in the Farnborough International Air Show held in the United Kingdom. During the present STA period, Boeing has demonstrated its equipment and service offerings to potential government and commercial customers on flights within the United Kingdom and over international waters (Boeing obtained appropriate authorization from the United Kingdom's Radiocommunications Agency for operations in UK airspace). Given the significant interest in Boeing's novel and important communications services, Boeing has a continuing need to experiment and to demonstrate its experimental stations. As a result, Boeing requests temporary authority to conduct the requested additional experimental operations until its underlying Experimental Modification Application is granted. In this connection, Boeing continues to work with the FCC staff to resolve certain regulatory issues associated with its experimental modification application and believes that a full resolution of relevant issues will be achieved in the near term. Indeed, Boeing is scheduled to meet with International Bureau staff on September 17, 2002, to address these and other issues relating to Boeing's operations. As discussed in the Experimental Modification Application and initial STA request, authorizing Boeing to conduct expanded experimental operations during the pendency of its modification application plainly would serve the public interest. For example, Boeing?s experimental operations will afford U.S. Government officials and decision makers access to real-time, broadband communications services aboard government aircraft, enabling them to communicate effectively and make timely and informed decisions affecting national security, foreign policy and other important U.S. Government matters. The need for U.S. Government access to such advanced communications services has never been clearer, particularly in view of the continuing war on terrorism and heightened international tensions. Accordingly, Boeing respectfully requests that the Commission expeditiously grant this STA renewal request prior to September 12, 2002.
